A preliminary injunction is one of the powerful remedy against the patent infringement for the patentee. The requirements of the preliminary injunction have been tightened due to the abuse of the preliminary injunction by NPE. The side effect of tightened requirements of the preliminary injunction has been raised that the trial for the preliminary injunction become longer. This article would like to introduce the legal principles of the injunction by the case study method and the comparison between the injunction of USA and Korea. As a result, it has been verified that the prompt relief of the preliminary injunction is important, and the potential damage of the patent infringer is already protected under the existing laws. It is desired to improve the proceeding related to the preliminary injunction for not to be delayed since the current proceedings of the preliminary injunction examine the inventive step of the patent for the examination of likelihood to succeed on the merits, one of the necessity requirement of preliminary injunction, and hope that this article is expected to support the above-mentioned efforts.
특허침해금지가처분은 특허권자에게 있어 특허 침해 행위를 조기에 금지할 수 있는 강력한 수단 중 하나이나, NPE가 이러한 권리를 남용함으로써 공공의 이익을 해치는 부작용을 막기 위해 그 행사 요건은 엄격해졌고 이로 인해 특허침해금지가처분 소송에 걸리는 기간이 길어지는 부작용이 발생하였다. 본 논문에서는 특허침해금지청구권 및 특허침해금지가처분에 대한 법리 분석을 위해 판례들을 연구하고, 미국의 금지청구권과 한국의 특허침해금지가처분을 비교하였다. 그 결과, 특허침해금지가처분의 신속성의 중요성 및 침해자가 입을 수 있는 타격의 가능성이 이미 기존 법률에 의해 보호되고 있음을 확인하였다. 특허침해금지가처분 절차에서 보전의 필요성 요건인 승소가능성을 판단하기 위해 특허의 진보성을 판단하여 절차가 지연되는 점을 개선할 필요가 있으며, 이러한 노력에 본 논문이 참고가 될 수 있으리라 기대한다.
