The Korean Supreme Court has unlimitedly accepted the protest for the free conducted technology unlike the supreme court of other country. I will examine whether such a protest for he free conducted technology should be accepted only for infringement by equivalents. Furthermore, I will examine whether the scope of the protest for the free conducted technology is recognized only if the subject invention is the same as the publicly known technology, or whether the ordinary technician can easily implement it from the known technology. So, I will study the requirements of protest for the free conducted technology.
확인대상발명을 대상으로 하는 자유실시기술의 항변에 대하여 우리나라 대법원은 해외 판례와 다르게 자유실시기술의 항변에 대해 무제한적으로 인정하고 있다. 이와 같은 자유실시기술의 항변을 균등침해에 한정하여 인정해야 하는 것은 아닌지에 대하여 검토해본다. 나아가 자유실시기술의 항변의 적용 범위가 확인대상발명이 공지기술과 동일한 경우에만 인정되는 것인지, 공지기술로부터 통상의 기술자가 용이하게 실시할 수 있는 경우도 인정되는 것인지도 검토하여 자유실시기술의 항변의 요건에 대해 살펴보기로 한다.
