Among the world-class global companies, the war over intellectual property through patent rights reaches its peak. Even more, intellectual properties have been used as one of the key instruments among nations to protect their own companies and industries. This research looks at the plans of US, China, Japan, Singapore and EU to reinforce their intellectual properties. In addition, I analyzed the present status of the Korean IP Hub plan from the case study.
Firstly, I analyzed Patent Hub plans for various nations and saw whether they could be applied to Korea. I prioritized the items that we need to complement by extracting key ideas from the Hub plans of US, China, Japan, Singapore and EU. One of the key results of this research is that we need to vitalize the Alternative Dispute Resolution(ADR) system to get the competitive advantage in the global intellectual property market.
This research suggests the followings: 1) Constitution of the Mediation Center specific to intellectual properties, 2) Improvement in legislation for vitalization of ADR, 3) Improvement in system for Expertise of ADR and 4) ADR professional training system. Furthermore, I raised an issue for ADR legislation by showing that most nations still do not institutionalize ADR systems. I believe my work could be the starting point to make the Global IP Hub.
세계를 주도하는 업체들 간에는 특허권을 필두로 한 지식재산전쟁이 정점에 이르렀다. 이는 기업들 간의 범위를 넘어서 해당 기업이 속한 국가들 간의 자국기업과 자국의 산업 보호를 위한 방법으로 지식재산권이 활용되고 있는 상황이다. 본 연구에서는 미국, 중국, 일본, 싱가포르, EU의 지식재산 강화 추진 계획을 살펴보았다. 또한 우리나라의 특허 허브 추진 사례 연구를 통해 우리나라의 특허 허브 추진 현실을 분석하였다.
각 국가의 특허허브 추진전략을 분석 및 정리하고 이 항목들에 대해 우리나라의 적용 적합성을 평가하였다. 주요 국가와 우리나라의 특허 허브 비교 분석에서는 미국, 중국, 일본, 싱가포르, EU의 특허 허브 추진 전략과 우리나라의 특허 허브 추진 전략을 종합하여 비교 분석함으로써 우리나라가 우선적으로 보완해야할 부분이 어떤 요소인지에 대해 도출하였다. 우리나라가 글로벌 지식재산 시장에서 경쟁력을 갖추고 주요 국가들과 대등한 입장에서 경쟁을 펼치기 위해서는 현재 상대적인 열세에 있는 ADR 제도 활성화 부분을 우선적으로 개선할 필요가 있다는 것을 도출하였다.
본 논문에서는 1) 지식재산 분야에 특화된 조정센터 신설, 2) ADR 활성화를 위한 법규 개선, 3) ADR 전문성 강화를 위한 제도 개선, 4) ADR 전문가 양성을 위한 교육 체계 강화 등 4가지 개선안을 제안하였다. 등 4가지 개선안을 제안하였다. 또한, 각국의 ADR 제도화 현황 분석을 통해 아직은 미약한 ADR의 활성화에 대한 이슈를 제기하였다. 본 논문에서 제시한 이슈들이 우리나라가 특허 허브 국가로 발전하는 데 조그만 초석이 되기를 기대한다.
