The central aspect of technology policy-making is its concern with the creative process through the development and diffusion of new technologies. Creation, or generation, of new technologies (innovations) is necessary but not sufficient to enhance economic social welfare. New technologies and innovations should also gain economic significance by displacing existing inferior rivals. The policy-maker's task is to enhance the rate of experimentation and the efficient selection of innovations in market and pre-market environments, which are the foci of this thesis. In this regard, the technology system's perspective is indispensable, and the thesis has tried to maintain and follow this perspective. More specifically, among others, the thesis has emphasized the following aspects.
Disclosure requirement of patent system enables innovators other than the patentee to improve the patented technology. Starting from patentee's efforts to disclose the minimum amount of information on patented technology to avoid profit erosion from competition with improved products in the product market, the thesis addresses a novel question of how to induce a patentee to voluntarily disclose the maximum amount of information on his/her invention. Based upon recent literature on patent and related innovation policy under sequential innovation, it is argued that, with properly adjusted patent scope, competition policy should allow ex post agreements for production joint ventures between sequential innovators so as to encourage the voluntary disclosure of information by an early innovator to subsequent innovators.
The nature (or size) of innovation is crucial in understanding the incentive to innovate. The thesis addresses the interrelationship between the nature of innovation, the incentive to license new technology, and the evolution of an industry. Under the Hahn-Novshek condition for Cournot duopoly, the small innovations are likely to be licensed. This behavior is innocent in the sense that the price declines and output increases. Further, this possibility of ex post technology license might lead R&D competition game to that of waiting game, contrary to the extensive literature on patent races.
Regarding the dissemination dimension of technology policy, less invention inevitably means less diffusion. Policies designed to promote creation of new technologies, however, often come at the expense of diffusion of new technologies. The thesis explores the need for integrating and synchronizing two policy goals under a unifying policy framework. Investigation of the theoretical backgrounds of technology policy revealed three crucial aspects of technology policy: imperfection of technology market, R&D-diffusion link, and cumulative nature of technological progress. Delineating with them, the thesis establishes principles for technology policy and proposes the "Diffusion Based Incentive System" as the unifying framework for technology policy formation and implementation.
전통적으로 기술 혹은 혁신은 지식(정보)의 독특한 경제적 특성으로 인해 분권화된 시장 메카니즘에 의해서는 사회적으로 최적인 자원배분이 이루어지지 않는다고 인식되어 왔으며, 이는 정책적 관점에서의 접근을 정당화하는 배경이 되어 왔다. 그러나, 최근의 급속한 신기술의 발달은 이른바 시스템적 혹은 누적적 기술진보의 특성을 반영한 기술정책의 수립에 관한 관심을 새로이 대두시키고 있다. 본 논문은 현대 사회의 기술 발전이 갖는 누적적 특성을 염두에 두고 기술 정책의 제도적 측면에 초점을 맞춘 연구이다.
먼저, 논문의 사전 연구단계로, 1980년대부터 게임 이론의 발전과 함께 분석되기 시작한 분야로써 이른바 "신혁신경제학" 이라 일컫는 문헌에 대한 검토에서 출발하고 있다. 즉, 과점적 기술 경쟁과 기술의 채택 및 확산에 관한 게임이론적인 연구에 대하여 심도있게 검토하였다.
이를 바탕으로 하여, 꾸르노 복점 상황 하에서의 혁신 유인에 대하여 분석하였다. 혁신의 유인에 관한 연구는 주로 독점 및 완전경쟁 상황을 비교하는 분석이 이루어져 왔고 이 경우 혁신의 성질 혹은 크기, 즉 대규모 혁신인가 혹은 소규모 혁신인가에 따라 혁신의 유인이 달라진다는 결론을 얻고 있다. 본 연구에서는 복점 상황에 대하여 분석하였고, 이 분석은 꾸르노 복점에 대한 안정성 및 존재성에 관한 가정 하에 이루어졌다. 분석 결과, 혁신의 크기가 충분히 작은 경우, 혁신을 달성한 기업은 사후적으로 해당 혁신의 라이센싱 유인을 갖게 되며, 이러한 라이센싱 의 유인은 기술경쟁의 특성을 선점 게임이 아닌 대기 게임의 특성을 갖도록 한다는 결론에 이르렀다. 부수적으로, 이 결과는 비협조적인 기술이전에 대한 충분 조건을 제시하고 있으며, 또한 산업 구조의 진화 과정에 있어서 "반응-재반응"이 일어나는 충분 조건을 정식화하고 있다. 다음으로, 최근 국내외적으로 뜨거운 감자로 떠오르고 있는 특허 제도의 재설계에 대하여 분석하였다. 최근의 특허 분석에서 주요 정책 수단인 특허 범위 와 누적적 혁신 하에서 초기 혁신자와 후속 혁신자 간의 라이센싱 가능성을 모형에 포함시켜 분석하였다. 특히 이 분석은 기존 문헌에서 간과되어 온 특허의 "후속혁신 유도기능"에 초점을 맞추어 분석하였다. 특히, 이러한 후속혁신 유도기능은 특허법 문헌에서는 "가능화 주의"라고 하여 매우 중요한 주제로 다루어지는 것으로 특허 출원시에 해당 발명 기술의 정보를 공개하도록 하는 특허 요건과 관계되는 것이다. 먼저, 특허 출원시 사적인 정보공개의 유인이 사회 최적과 괴리가 있음을 보였으며, 이를 해결하기 위한 정책 수단을 모색하였다. 그 결과, 특허 범위를 적정 수준에서 책정하고 초기 혁신자와 후속 혁신자 간의 공동생산벤쳐를 통한 기술공유가 가능한 경우에는 정보의 완전 공개가 이루어짐을 보였다. 특히, 특허 범위는 특허 혁신의 사회적 가치가 클수록 폭넓게 권리를 인정하는 것이 최적이라는 결론을 얻었으며, 이는 상당수의 특허침해 판례와 부합되는 결과이다.
다음으로 기술정책의 프레임에 관한 연구를 수행하였다. 이 연구는 기술 정책의 오랜 관행인 기술생성 혹은 개발 측면과 기술확산 측면을 분리하여 접근하는 시각에 대한 비판에서 출발하고 있다. 이론적 배경으로는 연구개발 혹은 기술경쟁 과정과 확산 과정 간의 상호 피드백을 분석하였고, 기술이 재화로써 갖는 특성과 그에 따른 시장실패 요인 및 대책 등을 분석하였다. 기술 확산에 있어서는 "확산은 빨리 이루어질수록 좋다" 는 낙관적 관점을 비판하고, 사회적으로 최적인 확산 수준이 존재함을 설명하였다. 또한 앞의 연구주제에서와 마찬가지로 기술 자체, 즉 눈에 보이는 기술의 확산 뿐만 아니라 눈에 보이지 않는, 즉 체화된 기술의 확산도 함께 고려하고 있다. 이를 바탕으로 혁신자 간의 기술 라이센싱을 최대한 활용하는 "확산기반 유인 시스템"을 설계하였다.
